Litigation Support/Expert Testimony
Dry Cleaner Facility, N. California:
In the context of litigation support, we developed chemical fingerprinting,
contaminant fate and transport considerations and mass calculations to
demonstrate that our client had minimal contribution to PCE in groundwater in an
area with several co-mingled plumes. This information was used to reach a
settlement in the case.
Industrial Facility, Orange County, California:
Developed approach in support of litigation at site where soils and groundwater
were impacted by TCE
and daughter products, in area with pre-existing chlorinated solvents in
groundwater. Our analysis was used as the basis for settlement among
multiple Potential Responsible Parties (PRPs).
South Tahoe Public Utility District v. ARCO et al. Provided evaluation and
expert testimony regarding the fate, transport and toxicity of MTBE in
groundwater. Demonstrated that MTBE impacts from our client’s property were to
perched water-bearing zones, not to the regional aquifer and that the
remediation systems were hydraulically containing the MTBE effectively.
The case was settled.
Jelicich v Safeco Insurance Co.: On behalf of the defense, demonstrated
through fingerprinting of various mold species and through fate and transport of
molds within a residence that the plaintiff’s assertions were invalid. Provided
expert testimony in the case. Jury ruled in favor of the defendant by a 12-0
and 11-1 vote on the two issues posed in the case. Cited in California Jury
Verdicts Weekly, Vol. 1, Issue 47, December 2, 2002
Frumeh Labow et al. vs. State of California Department of Transportation and
Magnetek National Electric Coil Company:
Litigation support on behalf of
property owner (plaintiff) on contamination of soils by PCBs and groundwater by
a wide range of chemicals. Case settled in favor of our client.
